A person who is over 18 years of age and has legal capacity can, and should, make a Will. 


To have legal capacity must be able to show that they fully understand and can communicate their decisions to others.


Conditions that impact a person’s legal capacity includes: brain damage, mental illness, degenerative diseases such as Alzheimer’s Disease, genetic conditions such as Down’s Syndrome, having suffered a damaging stroke, being affected by drugs or being of such advanced age that they no longer are able to understand or communicate their decisions adequately.
