A legal guardian is an adult designated to care for a child in case both parents die before that child reaches adulthood. It is important that you name a guardian in your Will so that the Court does not choose someone that you may not approve of. Unless you specifically name a guardian in your Will, anyone can step forward and ask for the job and the Court will make a decision on that person’s suitability.

If you and your spouse have separate Wills, it's best to name the same person as the guardian of your child to avoid conflicts.
