The proper formalities need to be met in order for a Will to be legally binding. These are:
the will must be in writing;
the will must be signed by the will-maker in the presence of two witnesses, present at the same time, preferably using the same pen. Both witnesses must be over 18 years of age, of sound mind and be able to understand the English language;
the will-maker and two witnesses must sign on the bottom of each page and on the last page of the will;
no writing or alteration should be made on a will after it is signed; and
the two witnesses should not be an executor or beneficiary under the will.
It is preferable that the person making the Will and the witnesses use the same black pen.
